BOMA Sacramento, Building Owners and Managers Association of Sacramento and the Central Valley, actively represents and promotes the interests of the commercial real estate industry in the greater Sacramento region through effective leadership &amp; advocacy, through the collection, analysis and dissemination of information, and through professional development.

BOMA Sacramento is proud to offer annual scholarships for those interested in a career in the Real Estate field.  There are two types of scholarships available.  Professional Scholarships are available for working professionals interested in joining BOMA Sacramento and/or interested in taking BOMA educational courses.  Student scholarships are available for students enrolled in college level Real Estate courses.

<p style="text-align: center;"><strong>WHAT IS AB 350?<br />
</strong>Displaced Property Service Employee Opportunity Act (AB 350)&nbsp;</p>
<p><strong>Imagine</strong> you have identified a building, ripe for upgrades, new TI’s and tenants.&nbsp; The existing service vendors have become complacent, are poorly trained or simply don’t meet your standards.&nbsp; The building needs a fresh approach.&nbsp; With a little of the professional expertise your company can bring to commercial real estate acquisition and/or management, the building is ready to contribute revenue and help invigorate the local economy. This is where the entrepreneurial spirit of Sacramento's commercial building industry rises to the top and your company is up to the challenge.</p>
<p><strong>Except</strong> if Assembly Member Jose Solorio (D Anaheim) gets his way, that is.&nbsp; Solorio has introduced a bill (AB 350) that dramatically undermines your ability to replace vendors’ employees working in the building, even if you switch service providers.&nbsp; <strong><span style="color: #4f81bd;">You will be forced to retain potentially underperforming, poorly trained individuals even if they don’t meet your performance standards.</span></strong></p>
<p>This bill institutionalizes mediocrity.</p>
<p><strong><span style="color: #4f81bd;">BOMA California has identified this bill as the single highest priority in the state impacting the commercial real estate industry, and uncharacteristically, this job killing, economically damaging bill is coming from an Orange County legislator.</span></strong>&nbsp;&nbsp;</p>
<p style="text-align: center;"><span style="color: #ff0000; font-size: 18px;"><strong>It’s time for BOMA Sacramento members to flex our muscles.&nbsp; <br />
BOMA Sacramento is asking for your direct help.</strong></span></p>
<p><strong>CURRENT LAW</strong></p>
<p>“Displaced Janitor Opportunity Act,” [SB 20 (Alarcon; D-Los Angeles), Chapter 795, Statutes of 2001] requires contractors and subcontractors, to retain for 60 days, certain employees (janitors) who were employed at that site by the previous contractor or subcontractor. </p>
<p>The act requires the successor contractors and subcontractors to offer continued employment to those employees retained for the 60-day period if their performance during that 60-day period is satisfactory. The current law authorizes an employee who was not offered employment or who has been discharged in violation of these provisions by a successor contractor or successor subcontractor to bring an action in any superior court. </p>
<p><strong>PROPOSED LAW</strong></p>
<p>AB 350 (Solorio; D-Anaheim): renames the act to the “Displaced Property Service Employee Opportunity Act” and expands the provisions of the act to licensed security guards, landscape, window cleaning, and food cafeteria services and dietary services in addition to janitorial and building maintenance services. The bill would extend the 60-day period in the act to 90 days. </p>
<p style="text-align: center;"><strong><span style="color: #ff0000;">WE OPPOSE AB 350 BECAUSE IT: </span></strong></p>
<p>1)&nbsp;&nbsp;&nbsp; Unfairly forces employers to hire a predecessor’s employees, </p>
<p>2)&nbsp;&nbsp;&nbsp; Undermines the at-will employment presumption in California, and </p>
<p>3)&nbsp;&nbsp;&nbsp; Is designed to ensure union representation, despite any change in employers. </p>
<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; AB 350 targets the commercial real estate industry by mandating that when a property comes under new ownership/management, subsequent employers must hire the predecessor’s employees. </p>
<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; This bill would have the State of California compel employers in one sector of the economy to hire specific individuals who happened to work for a terminated contractor. </p>
<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; This incredible intrusion into the private sector and burden on employers comes under the guise of protecting jobs in a bad economy. </p>
<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; However, if that notion were true and this policy made economic sense, then you might consider amending this bill to include all jobs in the state, and not just those in the commercial real estate sector. </p>
<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; This bill will not add or save any jobs in California, but will act as another cumbersome regulatory layer on CERTAIN employers. </p>
<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; It is also “solving” a problem that does not exist. The author has shown no evidence that these workers are being “disrupted.”&nbsp; We want to keep good and knowledgeable employees at building sites. </p>
<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; AB 350 will simply make it more difficult for commercial real estate managers to make personnel decisions.</p>
<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; This bill will make the transition of a property from one company to another more difficult, and may in fact cost jobs by preventing underperforming properties from taking the steps necessary to become healthy and profitable. </p>
